An undergraduate student is accused of cyberstalking.
Charges of cybersquatting have been brought against a university student who reportedly used former Nairobi Governor Mike Sonko to construct a Facebook account and deceive gullible Kenyans.
The unapproved registration and use of Internet domain names that are the same as or confusingly similar to service marks, trademarks, business names, or personal names is known as cybersquatting.
Third-year student Tyson Kibet made an appearance before Susan Shitubi, the Chief Magistrate of Milimani.
He refuted accusations that he had violated section 28 of the Computer Misuse Act by cybersquatting.
The charge document states that Kibet registered a Facebook account under the name Mike Sonko without the former county supervisor’s consent.
According to the prosecution, he purposefully created the aforementioned Facebook account on November 25, 2023, at an undisclosed location within the Republic of Kenya, with the objective of defrauding Kenyans by using Mike Sonko’s login credentials.
The prosecution begged the court to either release him on strict bond conditions or refuse him bond.
The prosecution further stated that there isn’t a single document in court that attests to his status as a student or that he has taken any exams.
The prosecution told the court, “Give bond terms relating to the offence.”
His attorney, however, took issue with the prosecution’s submission, arguing that since the accused is a student and has tests tomorrow, he should be released on a very light bail.
“He is a victim of circumstances, and even his classmates have contributed Sh50,000 to his bail money via a WhatsApp group. Please give him the money so he may go to class,” his attorney pleaded with the judge.
The accused was a young man who might be a student and might be taking examinations right now, thus the magistrate ruled in the case that he should be released on fair bond terms.
“I’ve heard the arguments put out by the defense and the prosecution. The magistrate stated, “The accused individual herein is a young man. He may be a student at the aforementioned college and may be facing ongoing exams.”
Kibet was freed by her after posting a Sh1 million bond or Sh200,000 in cash bail.
On June 10, the case will be discussed in pretrial proceedings.
