Kuppet threatens to sue TSC for terminating 742 JSS interns.
In response to the recent dismissal of junior secondary school intern teachers, the Kenya Union of Post-Primary Education Teachers has threatened legal action against the Teachers Service Commission.
742 intern instructors were packed off by the teachers’ employer on Monday, just two days after they canceled their nationwide walkout due to professional misbehavior.
Moses Nthurima, the deputy secretary general of Kuppet, claimed in a statement on Wednesday that TSC had not followed the proper procedures while terminating the instructors.
He said that the commission disregarded the instructors’ objections and thereby violated the natural justice principle.
“TSC has sentenced aspiring educators to unemployment.” Because TSC didn’t follow the proper protocol, we wish to denounce this regrettable situation,” Nthurima stated.
The TSC stated in letters of dismissal given to the impacted teachers that the tutors either did not reply to show cause letters delivered last month or did not answer in a way that was satisfactory.
The teacher’s employer said, “The commission has terminated your internship effective June 6, 2024, on the grounds that you failed and/or neglected to provide any justification for your absence from duty.”
The commission “found the same to be unsatisfactory and in view of the above, the commission has terminated your internship,” it informed a few of the respondents who sent comments.
Letters of show cause were delivered to 7,357 teachers on May 13 and letters of termination dated June 6 were submitted to school administrators on June 10.
After agreeing to some of their requests and presenting them to the budget committee ahead of Thursday’s budget presentation, the teachers, who had been on strike since April 17, decided to end their walkout.
According to Nthurima, the mutual understanding between the TSC and the union that instructors who consented to return to work would not face consequences was revoked.
In light of the severe measures taken by TSC against the intern teachers, he stated that the union will pursue legal recourse.
The deputy secretary of state further emphasized that all educators ought to be hired on a permanent and pensionable basis.
