Student accused of violent robbery against police officer.
Robbery with violence is the allegation levied against a 19-year-old student who is accused of assaulting a police officer on Kamiti Road and robbing him of a communication device.
On Tuesday, Ian Njoroge made an appearance before Milimani Principal Magistrate Ben Mark Ekhubi.
He refuted the three accusations.
Njoroge is charged in the charge sheet of robbing Corporal Jacob Ogendo of a police communication device and a cell phone valued at Sh50,000 on June 2, together with other people who are not in court.
The prosecution claimed that he had robbed the cop and injured him right away.
He was charged with a second offense alleging that he unlawfully beat up the officer and caused him great harm on the same dates and location.
The court was also informed that Njoroge had resisted being taken into custody by the aforementioned officer, Ogendo, who was acting lawfully at the time of the resistance.
The prosecution argued that the investigating officer had not completed documenting the witness testimony from other officers, and they were therefore against his release on bond.
In order to complete the statement-taking process and submit a formal application to refuse him bail, the DPP asked for three days.
But according to defense attorneys Duncan Okatch and Soyinka Lempaa, there aren’t any strong grounds to reject the accused’s bond.
“Just because the officers have not recorded statements does not warrant his detention,” Okatch, his attorney, said.
He lives in a fixed residence and attends a university. He was arrested at a house and has parents.”
Oktch proceeded to play a video that went viral in court showing an officer abusing the accused severely and brutally.
He pleaded with the judge to grant Njoroge a low bond amount.
Additionally, Njoroge was arraigned in traffic court to answer to three offenses.
The charges include obstructing traffic, transporting too many people in a Nissan Note, and disregarding an officer’s spoken instructions.
He is free on a Sh60,000 cash bond notwithstanding his denial of the charges.
The magistrate ordered Njoroge to be remanded at the Industrial Area Prison and sent to Kenyatta National Hospital for treatment.
On Wednesday, June 5, the prosecution will make a formal request to deny him bail, and the matter will be discussed.
