Sue Nancy Macharia is a female teacher. More than Unusual Deductions. Nancy Macharia is the target of female teachers’ complaints regarding alleged irregular deductions from their paystubs by the Teachers Service Commission (TSC) that total millions of shillings each month.
Over the past five years, these withdrawals have been made without explicit rules or policies about the use of the funds.
Regarding the same unauthorized deductions from teachers’ wages, TSC has been at odds with a number of organizations, including the Kenya National Union of Teachers (KNUT), the Ethics and Anti-Corruption Commission (EACC), and the Kenya Union of Post Primary Education Teachers (KUPPET).
Five KUPPET officials filed a lawsuit against their own union recently regarding BBF deductions. Their goal is to persuade the Teachers Service Commission to cease taking deductions and to get their money back that has been withheld over time.
A group of five KUPPET members filed a lawsuit to demand that KEWOTA discontinue its female deduction program. They accused the TSC CEO, the EACC, and the instructors Service Commission of breaking the law and violating the rights of female instructors.
Paul Rotich of the Nandi branch, William Lengoiyap of Samburu, Robert Miano of Laikipia, Peter Oluoch of Tana River, and Jentrix Ogola, the Kisii Vice Treasurer, are the members of KUPPET.
According to documents submitted to the Employment and Labour Relations Court in Nakuru, the KEWOTA deduction of Ksh. 200 made on the payslip of female teachers only identified the Social Welfare Association (SWA) as the recipient organization.
According to court documents, “TSC and its CEO often stop the deductions from time to time, for a month or so, after which they resume the deductions in an attempt to conceal the nature and cumulative amount of the deductions to confuse the affected teachers on how much has been deducted from them (Cumulatively).”
They assert that they have given the TSC CEO instructions to halt the withdrawals for the last five years since the company’s founding, but the commission and MS Macharia have persisted in taking money out of their paychecks for what they describe as personal reasons.
These educators are now asking the labor court to rule that the female deductions were unfair and financially embarrassing for the female teachers.

“They (teachers) are still unaware of the location, daily operations, and management of the organization that has been receiving their funds without their consent since the year 2019.”
The petitioner said in court documents that “the female teachers affected have had to contend with receiving an even lesser salary as a result of these illegal deductions, which money is not sufficient to cater for their needs in these harsh economic times.”
The petitioner has claimed that the commission implemented a “exit button” for Kuppet and KNUT members who want to quit the union after receiving the deductions from the third wage increment phase, in response to their raising this claim.
The matter was received, recorded in the system, and is currently being looked into, according to EACC.
