TSC Issues Circular Regarding Learner Safety in Educational Institutions.
The TSC has released a circular regarding student safety in schools. Ensuring students’ safety and well-being during class is essential for their overall development and academic success.
Apart from relevant legislation such as the Teachers Service Commission (TSC) Act of 2012 and the Education Act, the Kenyan Constitution provides clear guidelines and protections against inhumane treatment or punishment under Article 53.
Bullying: In order to completely eradicate bullying in all of its forms—verbal, physical, or psychological—schools must take the initiative. Student leaders shouldn’t have the authority to punish other pupils.
Physical Punishment
It is strictly banned to administer corporal punishment, and teachers who are caught doing so face disciplinary or legal action. Having clubs or other disciplinary instruments on hand is considered a professional offense.
Forcible Repetition: Since it violates the Basic Education Act, students shouldn’t be made to repeat grades. Rather, kids ought to receive assistance in moving on to the subsequent lesson and finishing each learning cycle.
Holiday Tuition: The Ministry of Education has set specified term dates that schools must follow. Students shouldn’t be held back during breaks or called back before classes officially resume.

Safety Standards: To create a favorable learning environment, schools’ physical infrastructure, such as their classrooms, dorms, and playgrounds, must adhere to safety regulations.
Sexual Abuse: Regardless of whether the alleged abuse takes place on school property or not, it must be investigated, documented, and handled promptly. It is the responsibility of educators and head teachers to protect kids against sexual abuse.
Drug and substance abuse: To protect pupils from the risks of drug and substance abuse, strict measures should be implemented in schools.
Guidance and counseling programs must to be extended to properly educate parents, guardians, and kids on the dangers of substance abuse.
Harmful Cultural Practices: School administrators should collaborate with law enforcement to address harmful cultural practices like child labor, early marriages, and exploitation that may have a negative impact on students’ wellbeing and academic development.
