TSC RULE ONE-THIRD (1/3) WITH THE FACILITY OF CHECK-OFF.
A crucial feature of employment laws governing deductions and financial agreements between employers, employees, and party organizations is the Teachers Service Commission (TSC) One-Third Rule and Check-off Facility.
According to the One-Third (1/3) Rule, an employee’s minimum pay deductions, whether required by law or made voluntarily, cannot be expected to exceed two-thirds (2/3) of their entire monthly compensation.
The Employment Act of 2007 outlines this provision explicitly, which attempts to safeguard employees’ rights and guarantee that they have adequate income to meet their financial commitments after deductions.
The Principal Obligations of Third Parties:
Third-party organizations are responsible for making sure that any proposed deductions from individual employees always comply with the one-third (1/3) need, based on established standards.
Before making any deductions, it is equally necessary for all firms to verify that the employee can meet their financial obligations.
The Voluntary Payroll Deductions’ Discontinuation:
Every employee has the option to stop voluntarily participating in payroll deductions by sending a written notification to the outside company.
While doing this, keep in mind that the workers’ undischarged liabilities are not included in the aforementioned provision.
Recommendations for Taken Against Defaulters:
The right to pursue appropriate legal action and steps to recoup any delinquent loans or credit facilities is retained by the parties.
It may also be necessary for the parties to inform any guarantors connected to the loan or credit facility defaulter.
If an employee fails to fulfill their financial commitments, it could be deemed misconduct and subject them to disciplinary action by the Commission.
Remittance of Service Fee:
In order for TSC to process deductions, data, information, reports, and other associated services for the check-off facility, the third parties must pay a service charge.
It is significant to remember that the TSC sets the applicable rates for the service charge, which must be completely absorbed with third parties.
