TSC to meet with MPs on 46,000 JSS intern teachers recruitment.
The Teachers Service Commission (TSC) and the National Assembly Education Committee will meet tomorrow to discuss the hiring of 46,000 interns from junior secondary schools.
TSC is also anticipated to evaluate the committee’s progress on teacher promotions in their 40s and 50s.
Following a Court of Appeal decision last week that delayed plans to hire 46,000 intern teachers on permanent and pensionable conditions, the discussion with MPs is taking place shortly after.
The Employment and Labour Relations Court’s (ELRC) orders that TSC convert the internship to permanent and pensionable terms were suspended by Justices Asike Makhandia, Sankale Ole Kantai, and Ngenye Macharia.
Until the commission led by Nancy Macharia hears and rules on the issue, the interns will have to stay on as interns.
TSC stated in its application that the directives from Justice ELRC had completely thrown its preparations into disarray because they had not budgeted for the money needed to recruit the intern instructors on permanent and pensionable terms.
“The rights of all learners in public schools underpinned under Articles 43 and 53 of the Constitution are on the verge of being violated as the Commission has no financial resources to on-board the 46,000 on permanent and pensionable terms and conditions,” Allan Sitima, a lawyer for the TSC, said
TSC is now working to convert over 46,000 intern teachers to permanent and pensionable posts, however there is a large cash gap of Sh3.2 billion.
There is a significant cash deficit because TSC initially predicted that Sh16.6 billion would be required to complete the conversion, even though the government has committed Sh13.4 billion for the purpose.
After several months of conflict over a strike, layoffs, and an ongoing legal battle between the interns and the TSC, the allocation was finally resolved.
Sh13.4 billion was suggested for this purpose by Treasury Cabinet Secretary Njuguna Ndung’u during the 2024–25 budget presentation to Parliament.
This plan, while large, falls short of meeting the TSC’s funding requirements.
